Experience

Mr. Fredette has a litigation and non-litigation practice.

On the litigation side, Mr. Fredette represents clients in contractual disputes in federal and state courts and alternative forums throughout the United States. The representation includes disputes arising under all forms of insurance policies (e.g., general liability, excess and umbrella, directors and officers, errors and omissions, life and disability and, among others, pollution), contractual indemnity agreements and other risk allocation agreements.

In his non-litigation practice, Mr. Fredette advises clients on the local, national and international level with regard to insurance coverage and contractual indemnity disputes relating to various claims, including intellectual property, product, business torts, constitutional, bodily injury, property damage and pollution claims.

Mr. Fredette is also retained to assist clients with appellate matters, including evaluating civil proceedings for appellate issues, as well on the briefing side.

Recent Representative Matters

Successful result in MDC et al. v. Interstate Fire & Casualty Co. et al., United States District Court, District of Colorado, a $64 million contractual and extra contractual action on the duty to indemnify in connection with underlying property damage and bodily injury lawsuits.

Successful result in Koby International Inc. et al. v. Granite State Insurance Company, United States District Court, Central District of California, a several hundred thousand dollar contractual and extra contractual action on the duty to defend and indemnify in connection with an underlying trademark and trade dress lawsuit.

Successful result in in Richmond American Homes of Nevada v. Central Grading Company et al., Nevada District Court, Clark County, a several hundred thousand dollar contractual and extra contractual action on the duty to defend and indemnify in connection with an underlying property damage lawsuit.

Successful result in Cubic Corporation v. Lexington Insurance Company et al., California Superior Court, County of Los Angeles, an over $1 million contractual and extra contractual action on the duty to indemnify in connection with an underlying bodily injury lawsuit.

Successful result in Travelers Insurance Company et al. v. National Union Fire Insurance Co. of Pittsburgh, PA et al., United States District Court, Northern District of California, a $16 million contribution action on defense and indemnity arising out of an underlying property damage lawsuit.

Successful result in Phillips v. Mutual of Omaha, United States District Court, Eastern District of California, a several hundred thousand dollar contractual and extra contractual lawsuit on the duty to pay benefits under a disability policy to an accountant.

Successful result in Mora Labor Contracting et al. v. Insurance Company of the State of New York et al., United States District Court, Eastern District of California, a several hundred thousand dollar action alleging fraud in connection with obtaining an insurance policy.

Successful result in Berg v. Mutual of Omaha, United States District Court, Eastern District of California, a several hundred thousand dollar contractual and extra contractual lawsuit on the duty to pay benefits under a life policy.

On the non-litigated side, Patrick was recently retained for advice in connection with a variety of complex matters, including enforcing contractual indemnity and insurance procurement obligations from suppliers relating to multiple e-coli claims; insurance issues arising out of twelve underlying putative class action lawsuits filed in twelve different states alleging damages of over $50 million for violation of the Telephone Consumer Protection Act, 47 U.S.C. § 227 et seq.; insurance issues arising out of an underlying trademark lawsuit alleging damages of over $18 million; insurance issues arising out of three underlying lawsuits filed in three different states alleging damages of over $30 million for disparagement and related business tort claims; and, among others, insurance issues arising out of seven underlying lawsuits filed in three different states alleging damages of over $3 million for product liability claims.

Mr. Fredette is a member of the California, Idaho, Ohio, and Washington State Bar Associations, as well as admitted in the U.S. District Courts in the states of California, Colorado, Idaho, Indiana, Kentucky, Ohio, Vermont, and Washington. Mr. Fredette is also a member of the Defense Research Institute, Northern California and Nevada Association of Defense Counsel, and Ohio Association of Civil Trial Attorneys.
